THE REFORM OF THE CIVIL CODE AND THE CAPABILITY REGIME
A CRITICAL ANALYSIS IN LIGHT OF INTERDEPENDENT AUTONOMY

This article investigates whether the changes foreseen in Bill No. 4 of 2025 (Reform of the Civil Code) for the civil capacity regime comply with the fundamental principles of the Convention on the Rights of Persons with Disabilities. In dialogue with the feminist theoretical framework and with a hypothetical-deductive approach, interdependent autonomy is seen as a paradigmatic value of this treaty. The static and independent concept of civil capacity is then re-discussed. Fundamentally, articles 3, 4 and 4-A of the Reform are evaluated, approaching decision-making as an exercise in connection, that is, with supports and accommodations. It is concluded that, with a view to rescue the dogmatic coherence of the legal system, the project fails to deeply review the concepts and techniques of the capabilities regime, keeping them tied to the substitute approach to decision-making.
