THE ABUSE OF ADMINISTRATIVE DISCRETION IN THE REFORM OF CONAD: THE EXECUTIVE POWER AT THE SERVICE OF AUTHORITARIAN ADMINISTRATION

Abstract

This article discusses the use of administrative discretion as a justification for the reform of the National Council on Drug Policy (Conad), carried out during the government of Jair Messias Bolsonaro (2018-2022). The method adopted was analytical-deductive, based on the theoretical analysis of the legislation and the literature on the subject. As a conclusion, it was argued that due to the instrumentalization of administrative discretion by the President of the Republic in favor of increasing power, the Conad reform can characterize the current administration as monological, distancing itself from the paradigm of consensual and dialogical administration.
