UNDERREPORTING OF MARRIAGE RAPE ON RISK ASSESSMENT FORMS

Rape is the most serious form of violence against sexual dignity, encouraged by stereotypes of sexual roles and women's social position. Marital rape also carries the immense difficulty in denouncing the crime that takes place at home, immersed in an affective relationship and a mixture of antagonistic feelings. The objective of the study is to assess whether the incidence of sexual intercourse without consent among women who required urgent protective measures is compatible with the estimate of underreporting of marital rape. The methodology used was empirical documentary research for quantitative data collection, from 01/01/2021 to 12/31/2021, of risk assessment forms attached to online requests for protective measures in the capital Campo Grande of the State of Mato Grosso do Sul in comparison with national and international regulations on the subject from the feminist perspective of law. The research aims to shed light on marital rape, which requires greater awareness among women and the improvement of the criminal justice system from a gender perspective.
