REFORMA AGRÁRIA: O EXERCÍCIO DA FUNÇÃO SOCIAL DA TERRA OBSTADO PELA MANUTENÇÃO DO LATIFÚNDIO

Abstract

This article seeks to analyze how the institute of private property took place in Brazilian lands since the time of imperial Brazil, passing through the sesmarias and, from them, the emergence of private property with a clearly economic and capitalist bias and, in turn, the emergence of the latifundium, also analyzing the issue related to the need to implement the real agrarian reform described in the constitutional text, which to date has not been carried out, mainly as a result of the obstacles and mishaps intentionally placed in the Federal Constitution, especially by the weight and strength of the ruralist bench. The social function of land as a means of implementing this public policy of agrarian reform is also discussed and analyzed. As for the methodology, the deductive-argumentative method was used, having as theoretical references José de Souza Martins and Lígia Osório Silva, in addition to a bibliographic review in sources such as books, scientific articles and legislation on the proposed theme.

Graduated in Law from the Catholic University of Goiás - UCG (1993), Master in Law from the Federal University of Goiás - UFG (2003) and Doctor in Law from the University of Brasília - UnB (2016). He is currently Adjunct Professor of the Law Course at UFG - Regional Goiás and Permanent Professor of the Postgraduate Program in Agrarian Law at FD/UFG (Master's and Doctorate).
