The purpose of this article is to study the fabricated demands alluding to bank loan contracts and declaratory actions for the absence of debts, proposed within the scope of the 4th Small Claim Civil Court of the District of Mossoró to mature measures to contain actions of this nature, avoiding the affect the efficiency and celerity of the judicial provision. For this, empirical data from the experience acquired by the researcher were recruited, organized by theme and defined by sampling, in order to provide an overview of the profile of the litigants and their strategies for obtaining undue advantages through the judicial process. Furthermore, it was possible to present mechanisms for the improvement of the brake system of inconsequential litigation, with the intention of inhibiting the excesses practiced by predatory law without compromising access to justice, even in the face of fraudulent postures in the context of the judicialization of conflicts
