Abstract

There has been an expansion of scientific research about the judiciary formulated by members of the magistracy. On the one hand, this circumstance may generate some skepticism regarding the results of investigations, given the doubts about the presence of the critical spirit of the investigator. On the other hand, there is the advantage of having greater knowledge of those who formulate research on what is investigated. In this context, the present article aims to understand the scientific relevance of the presence of magistrates in research about the judiciary, and then point out obstacles and potentialities in such kinds of investigations. In methodological terms, the text dialogues with the theoretical tradition coming from Anthropology, which has focused on ethnographic works in which the researcher turns to his own environment. The text also dialogues with the Epistemology, especially the Critical Epistemology, and its notes about the absence of neutrality of scientific knowledge and the need for social engagement in the construction of knowledge. Finally, it is concluded that, in a country of wide citizen demand for the judiciary, such as Brazil, the research formulated by judges fulfills the social function expected of science, enabling the improvement of the judicial public service.
